MyChart Terms and Conditions of Use
Please read carefully. Your acceptance indicates that you have read, understand, and agree to these MyChart Terms and Conditions of Use. If you are acting as a MyChart proxy for another individual, these MyChart Terms and Conditions of Use shall apply to your proxy access in the same manner as they apply to your own MyChart access.
1. Log In
I understand that I must log into MyChart using my own user name and password.
2. Not an Emergency Response System
I understand that MyChart’s messaging system is not an emergency response system and should never be used as a substitute for calling 9-1-1 or for seeking immediate medical attention at a local emergency room in the event of an emergency.
3. Communications
The anticipated turnaround time for responses to electronic messages sent through MyChart is two (2) business days; however, timely responses are not always possible. Accordingly, urgent or emergency messages should not be submitted via MyChart. I understand that electronic messages that I send through MyChart may be shared with clinical staff who assist in providing my medical care. Therefore, use of MyChart may not be appropriate for sending very sensitive information I wish to discuss directly with health care providers.
I also understand that my physician or another member of the Community First Medical Center health care team may send me messages through MyChart that may contain important information concerning my health care, and that it is my responsibility to monitor these messages. I understand that I have the option of entering an email address that may be used to notify me of the presence of MyChart messages, and that if I opt to provide this email address, I will update my email address on MyChart as needed.
4. User ID and Password Confidentiality
I understand that my user ID and password are key to protecting the confidentiality of the information in MyChart. I understand that my MyChart user ID and password are not to be shared with anyone. I understand that if I share my user ID and password with another person, that person will be able to view my medical information and the medical information of anyone for whom I am a MyChart proxy (including children). I understand that it is my responsibility to keep my user ID and password safe and secure and to change them anytime I believe the security of that information may be compromised. I understand that it is my responsibility to log out of active MyChart sessions and to take appropriate precautions when accessing MyChart, including from my home, business, or a public computer, and when printing or copying any medical information from MyChart. Community First Medical Center is not responsible for any loss or damage arising from my failure to comply with the provisions of this Section 4 (User ID and Password Confidentiality).
5. Email Notifications
I understand that, as a MyChart user, I will receive an email notification anytime new information is available in MyChart. The notification itself does not contain any medical information; however, I understand that if I do not want others to see the notification, it is my responsibility to take appropriate precautions with respect to my email account.
6. Eligiblity
MyChart is available only to patients under the active care of a Community First Medical Center physician. I understand that all communication through MyChart will be in regard to my own health conditions, and that asking for advice on behalf of another person could potentially be harmful and is a violation of these MyChart Terms and Conditions of Use. Community First Medical Center does not assume any responsibility for health information or services used by persons other than the MyChart enrollee. I agree to not use or exploit any portion of MyChart to provide any commercial services to third parties.
Community First Medical Center does not offer or provide products and services for children. If I am under eighteen (18) years of age, I agree not to use MyChart. Community First Medical Center does not intend to collect Personal Information from children. If my child has submitted Personal Information and I would like to request that such information be removed, I understand that I may contact Community First Medical Center.
7. Proxy Access
I understand, acknowledge and agree that I can allow a family member or other person to access the information about me in MyChart as my “proxy” and that if I authorize another person to serve as my proxy in MyChart, that person will be able to access all of the information in MyChart account, including sensitive test results and diagnoses such as pregnancy test results, toxicology test results, HIV and other sexually transmitted disease results and genetic test results. I further understand and agree that it is my responsibility to terminate any proxy access that I no longer want by contacting my physician’s office.
8. Privacy
This Section 7 (Privacy) covers the on-line privacy practices of Community First Medical Center with respect to use and disclosure of information provided through MyChart. I understand that additional terms concerning how my identifiable health information is used and disclosed are disclosed in the “Notice of Privacy Practices,” which is accessible at [** http://www.cfmedicalcenter.com/notice-privacy-practices/ ].
I recognize that I am required to provide certain personally identifiable information (“Personal Information”) to use certain features and functions of MyChart. The Personal Information I provide includes information provided during any registration process, including my social security number and date of birth, and any other identifying information (including health information) that I submit voluntarily while using MyChart, including information I submit in any form.
I understand that Community First Medical Center may use Personal Information obtained from me to respond to my questions or inquiries; respond to my requests, including requests for referrals, prescription refills, and requests for advice regarding my health condition or my health record; to fulfill my requests for appointments; to honor or contact me regarding my requests to change the Information contained in my MyChart account; and to identify areas of user interest and consider potential improvements to or analyses of MyChart. In addition, unless I opt out of this feature, I agree that my Personal Information may be used to send me an email informing me that I have new Information in my MyChart account.
Community First Medical Center computer resources may be monitored for all lawful purposes, including to ensure that use is authorized, for system management, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. Monitoring includes security testing by authorized entities to test or verify the security of this system. I understand and agree that I am responsible for all information that I submit to or through MyChart.
9. Not the Complete Medical Record
I understand that MyChart contains selected, limited medical information from my traditional paper medical record and that it does not reflect the complete contents.
10. Audit
I understand that my activities within MyChart may be tracked by computer audit and that any entries I make and messages I send may become part of my medical record. Community First Medical Center computer resources may be monitored for all lawful purposes, including to ensure that use is authorized, for system management, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. Monitoring includes security testing by authorized entities to test or verify the security of this system.
11. Third Party Website Information
I understand that MyChart may offer links to third party websites that are not managed or controlled by any Community First Medical Center entity or my physician. These websites are made available for educational or informational purposes only, and the availability of such websites through MyChart in no way implies an endorsement or verification that the information on these sites is accurate. I should not rely on the information found in these sites for treatment, diagnosis, or any other medical purpose.
12. Deactivation
I understand that access to MyChart is provided as a convenience to patients and that MyChart access may be modified, suspended, or discontinued at any time without notice. I further understand that my access, including proxy access to MyChart, may be deactivated at any time, including for improper use. Improper use includes, but is not limited to, use of inappropriate or abusive language, requesting appointment times that are not needed or are frequently cancelled, and other activities that are disruptive to clinic operations. I understand that my use of MyChart is voluntary and that I am not required to use MyChart or to authorize another person as my MyChart proxy.
13. No License
The content of MyChart is provided for health care providers, patients, and their authorized proxies only. Nothing in MyChart should be construed as granting any license or right to use any proprietary trademark, service mark, logo or name displayed in MyChart.
14. No Guarantee of Accuracy
Although every attempt is made to ensure the integrity of MyChart, no guarantees whatsoever are made as to the correctness or accuracy of MyChart or any data provided through MyChart. I understand that if I identify an inaccuracy in my information in MyChart, I will inform my physician’s office.
15. No Warranty
MyChart is provided on an “as is” and “as available” basis. There are no guarantees, assurances, or warranties with regard to the information and services of MyChart, or its availability, reliability, quality, or performance at any given time, or any Information provided therein, and all such warranties and conditions of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement are expressly disclaimed. Access to MyChart is dependent upon the networks and services of third party internet, telecommunications and hardware providers. I understand that Community First Medical Center, its affiliates, any affiliated providers, and my physician are not responsible for any actions or omissions of these third party providers and are not responsible for any technical difficulties experienced by such third party providers or my use of third party providers and their services or products in connection with MyChart. I understand and acknowledge that, to the extent permissible under applicable law, my sole and exclusive remedy with respect to any defect in or dissatisfaction with MyChart is to cease to use MyChart.
16. Limitation of Liability
I expressly understand and agree that Community First Medical Center shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, without limitation, damages for loss of profits, goodwill, use, data loss, or other losses (even if Community First Medical Center has been advised of the possibility of such damages) resulting from: (i) the use or inability to use MyChart, (ii) any link provided in connection with MyChart, (iii) my reliance on MyChart or my failure to read or access MyChart in a timely manner; (iv) the interruption, suspension, termination of MyChart; or (v) any matter otherwise related to my use of MyChart. Notwithstanding the foregoing, I agree that in no event shall Community First Medical Center’s liability to me relating to MyChart exceed one hundred dollars ($100).
17. Intellectual Property
MyChart is owned by Community First Medical Center and third parties and is protected by the United States Copyright Act of 1976, as amended, and the copyright laws of other countries. Certain materials are used by permission of their respective owners. I agree that the design, look, feel, and text of MyChart (“Content”) may not be copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way without the prior written permission of Community First Medical Center, except that, subject to my compliance with these MyChart Terms and Conditions of Use, I am authorized to view and print copies of the Content in connection with my use of the Information, provided that I keep intact all copyright, trademark, and other proprietary notices. Modification of Content or use of Content for any other purpose is a violation of the rights of Community First Medical Center or third parties. Nothing herein shall be construed as conferring by implication, estoppel, or otherwise, any license or right under any copyright, patent, trademark or other proprietary interest of Community First Medical Center, or third parties. Trademarks used on MyChart are used with the permission of their respective owners. I agree not to use or display trademarks without the prior written consent of Community First Medical Center or the owner of such mark.
18. Medical Disclaimers
MyChart contains certain content and information relating to my medical history, medical record and other related information (“Information”). I understand that the Information available through MyChart is for informational and educational purposes only, and is not a substitute for an in-person consultation with a healthcare professional and the professional judgment of a healthcare professional in diagnosing and treating patients. I should always consult with my physician or other qualified health provider for advice or to ask any questions I may have regarding a medical condition. Use of MyChart is not a consultation with a health care professional. I should never disregard professional medical advice or delay seeking it because of something I have read on MyChart.
My reliance upon any Information I obtain at or through MyChart is solely at my own risk. It is solely my responsibility to evaluate the accuracy, completeness and usefulness of all Information. With respect to any electronic communications I send through MyChart, I understand that any responses I may receive will be based on and limited to the information provided through MyChart. If there is insufficient information provided, the services provided may not be accurate or reliable.
19. Modification and Amendment
I acknowledge that Community First Medical Center may at any time, and without notice, amend these MyChart Terms and Conditions of Use. I understand that I should periodically visit [** http://www.mychart.cfmedicalcenter.com/mychart/ ] to review the current MyChart Terms and Conditions of Use to which I am bound.
20. Indemnity
I hereby agree to indemnify, hold harmless, and upon request, defend, my physician, Community First Medical Center, its affiliated entities, and any affiliated providers, and as to each of the foregoing their officers, directors, employees, agents, licensors, suppliers, successors, and assigns, from and against any and all claims, actions or demands, liabilities, settlements, losses, expenses (including, without limitation, reasonable attorneys’ fees) resulting from or alleged to result from my violation of these MyChart Terms and Conditions of Use.
21. Waiver and Release
I hereby agree to waive and release my physician, Community First Medical Center, its affiliated entities, and any affiliated providers, and as to each of the foregoing their officers, directors, employees, agents, successors, and assigns from any and all claims or causes of action that are in any way related to my use of MyChart, both on my own behalf and on behalf of any individuals that have authorized me as their MyChart proxy.
22. Relationship
I agree that there is no physician-patient relationship between me and Community First Medical Center arising solely by virtue of MyChart.
